Die Arbeit widmet sich der Patientenmobilität, deren Rechtsentwicklung mit den grundlegenden EuGH-Urteilen Decker und Kohll im Jahr 1998 ihren Anfang nahm und in dem Erlass der RL 2011/24/EU ihren vorläufigen Höhepunkt fand. Die auf der Auslegung der Dienstleistungs- und Warenverkehrsfreiheit beruhende Rechtsprechung führte zu beachtlichen Fortbildungen im Recht der Grundfreiheiten und sah sich von Beginn an dem schwerwiegenden Vorwurf ausgesetzt, die mitgliedstaatliche Souveränität im Bereich der Gesundheitsversorgung zu unterlaufen. Die Arbeit erfasst das dreischichtige unionsrechtliche Regelungsgefüge bestehend aus Grundfreiheiten, RL 2011/24/EU sowie VO (EG) Nr. 883/2004 und untersucht die zugrundeliegenden grundfreiheits- und kompetenzdogmatischen Fragestellungen. Bei der Überprüfung der Umsetzung der Vorgaben in das deutsche SGB V werden einzelne Umsetzungsdefizite aufgezeigt. Abschließend blickt die Arbeit auf tatsächliche und ökonomische Aspekte der Patientenmobilität.»Cross-Border Healthcare in the European Union«Since the cases Kohll/Decker in 1998, the ECJ has been establishing principles of European cross-border healthcare. These judgements raised numerous questions on the interpretation of the fundamental freedoms and the Union’s competences. The ECJ's case law, the Regulation (EC) No 883/2004 on the coordination of social security systems and the recently adopted Directive 2011/24/EU now constitute a three-layered legal framework that has to be transposed into German social security law.
